Goa Government once again invokes section 144, CrPC as COVID cases escalate

Owing to the increasing number of COVID positive cases in the State, the Offices of the District Magistrate in the North and South Goa districts, on 16/07/2020, have passed orders under Section 144 of the Criminal Procedure Code, 1973 in order to contain the spread of the virus.

The orders impose strict ban on operations of all shops/ establishments except essentials. Further, it imposes a ban on restaurants, tea shops, pan shops, street food vendors, other food shops/joints (dhabas, gaddas), beach shacks and all other types of eateries. Additionally, the functioning of public transport except taxis, markets except essentials, Government offices excluding those pertaining to essential Government functioning and private offices excluding those pertaining to essential services, sports complexes, shopping malls, wine and liquor shops and all religious places and places of worships for the public have been restricted.

The order further mentions that any person contravening the conditions of the same shall be punished under Section 188 of the Indian Penal Code.

The said order has come into force with effect from 20.00 hrs of 16/07/2020 and shall stay in force till 06.00 hrs of 20/07/2020 in the State.
